CUSTOM DESIGN TERMS

These Custom Design Terms apply to all creative services purchased from or commissioned through Saiyans, including fight posters, fighter branding, campaign graphics, apparel designs, promotional visuals, social media content, motion graphics, digital paintings, and other custom artwork.
By purchasing a custom service, approving a quotation, paying a deposit, or asking Saiyans to begin work, you agree to these terms.
1. Scope of the project
The scope of each project is determined by:
- The relevant product or service page;
- The selected package;
- The written quotation;
- The invoice;
- The approved creative brief;
- Any additional written agreement between Saiyans and the client.
Only the deliverables expressly included in the agreed scope are included in the price.
Printing, physical delivery, source files, animation, additional formats, social media variations, language adaptations, logo design, copywriting, or other services are not included unless specifically stated.
2. Payment and project confirmation
Unless otherwise agreed in writing, full payment is required before work begins.
For larger projects, Saiyans may accept a deposit. The amount and payment schedule will be shown in the quotation or invoice.
A project is considered confirmed only after:
- The required payment has been received;
- The client has submitted the creative brief;
- All necessary materials have been supplied;
- The project scope has been sufficiently confirmed;
- Saiyans has confirmed availability.
An estimated delivery date is not reserved until these requirements have been completed.
3. Client materials
The client must provide all required materials, including where relevant:
- High-resolution photographs;
- Logos and sponsor assets;
- Names, titles, dates, records, and event information;
- Brand guidelines;
- Required dimensions and formats;
- Examples and visual references;
- Mandatory legal wording;
- Accurate spelling and approved copy.
Low-resolution, compressed, blurred, filtered, cropped, or incomplete materials may reduce the quality of the final result.
Saiyans is not responsible for limitations caused by the quality of client-supplied materials.
4. Rights to client-supplied content
By providing photographs, videos, names, logos, trademarks, music, fonts, sponsor assets, or other materials, the client confirms that they own the materials or have obtained all necessary permissions to use them.
The client is responsible for securing any required permission from:
- Athletes and models;
- Photographers and videographers;
- Sports organizations and promotions;
- Sponsors and commercial partners;
- Trademark and copyright owners;
- Music, font, image, or stock-asset licensors.
Saiyans is not responsible for claims arising from unauthorized, misleading, or unlawful materials supplied by the client.
5. Turnaround time
Turnaround times displayed on the Site are estimates, not guaranteed deadlines, unless Saiyans expressly confirms a fixed deadline in writing.
The turnaround period begins only after complete payment, receipt of all required materials, and confirmation of the creative direction.
Delivery may be delayed by:
- Missing or inaccurate information;
- Late client responses;
- Low-quality or unsuitable photographs;
- Changes to approved content;
- New sponsor requirements;
- Changes to names, records, dates, or event details;
- Additional revision requests;
- Technical problems or events outside our reasonable control.
Priority or rush delivery remains subject to availability.
6. Rush services
Where a priority or rush service is purchased, the stated production time begins only after all required materials and confirmed information have been received.
The rush fee compensates for the reservation and reorganization of the production schedule. Once the priority production slot has been reserved or work has started, the rush fee is non-refundable to the extent permitted by law.
7. Revisions
Unless the product page or quotation states otherwise, a custom design includes two revision rounds.
One revision round means one consolidated list of reasonable adjustments submitted at the same time.
Examples of included revisions may include:
- Small colour adjustments;
- Typography corrections;
- Minor positioning changes;
- Replacement of incorrect text;
- Limited adjustments to effects;
- Reasonable refinements within the approved direction.
The following are not considered minor revisions:
- Requesting a completely new concept;
- Changing the main photograph after design work has started;
- Changing the approved art direction;
- Rebuilding the full composition;
- Adding new deliverables or formats;
- Adding people, sponsors, or major elements not included in the original brief;
- Recreating a design after final approval.
Requests outside the original scope may require an additional quotation and payment.
8. Feedback
Feedback must be clear, specific, and consolidated.
Where several decision-makers are involved, the client must appoint one person to collect and approve all feedback.
Contradictory instructions from multiple representatives may delay the project and result in additional charges.
The client should normally provide feedback within seven business days of receiving a preview.
Projects left without feedback for more than 30 calendar days may be placed on hold or treated as inactive. A reactivation fee may apply before work resumes.
9. Approval and proofreading
The client is responsible for checking all details before final approval, including:
- Spelling;
- Names;
- Dates;
- Fight records;
- Event information;
- Sponsor logos;
- Contact details;
- Social media handles;
- Dimensions;
- Required legal wording.
Once the client approves the final version, Saiyans is not responsible for errors that were visible in the approved artwork.
Changes requested after approval may be treated as a new revision or a new project.
10. Final deliverables
Final deliverables will be supplied in the formats stated on the product page or quotation.
These may include JPG, PNG, PDF, MP4, or another agreed delivery format.
Editable working files and source files—including Photoshop, Illustrator, After Effects, Nuke, 3D, project, layered, or raw production files—are not included unless expressly purchased or agreed in writing.
Saiyans is not required to provide unused concepts, tests, drafts, rejected versions, production files, or internal working materials.
11. Intellectual property
Saiyans retains ownership and copyright in:
- Working files;
- Drafts and unused concepts;
- Production methods;
- Templates and reusable systems;
- Pre-existing materials;
- Any elements not expressly transferred in writing.
Once full payment has been received, the client receives a license to use the final approved deliverables for the commercial purposes agreed in the project scope.
Unless the quotation states otherwise, this license is worldwide and permits use on the client’s social media, website, promotional materials, event communications, and agreed printed media.
The license does not permit the client to:
- Resell the artwork as a standalone design;
- Sell editable files;
- Register the artwork as a trademark without written authorization;
- Claim authorship of the artwork;
- License the artwork to unrelated third parties;
- Use rejected or unpaid concepts;
- Use the artwork for products or merchandise not included in the agreed scope.
Exclusive ownership, copyright assignment, merchandising rights, resale rights, or unrestricted third-party licensing must be agreed separately in writing and may require an additional fee.
12. Portfolio and promotional use
Unless a written confidentiality agreement states otherwise, Saiyans may display completed and publicly released work in:
- Portfolios;
- Websites;
- Social media;
- Presentations;
- Promotional materials;
- Award submissions;
- Behind-the-scenes content.
Saiyans will not intentionally publish confidential event information before its official release where an embargo has been clearly communicated and accepted in writing.
13. Cancellation and refunds
Before work begins, the client may request cancellation and a refund, subject to any non-recoverable payment fees where permitted by law.
After work has started, the amount corresponding to work already completed, reserved production time, third-party costs, and committed expenses is non-refundable.
Where part of the payment relates to work that has not yet been performed, Saiyans may refund the unearned balance after deducting completed work and non-recoverable expenses.
No change-of-mind refund is normally available after:
- The final artwork has been approved;
- The final files have been delivered;
- All included work has been completed;
- A digital file has been downloaded following the client’s express request for immediate delivery.
This does not affect mandatory rights relating to defective or non-conforming services.
14. No guarantee of commercial performance
Saiyans provides creative and visual services but does not guarantee:
- Sales;
- Engagement;
- Followers;
- Media coverage;
- Sponsorship;
- Event attendance;
- Advertising performance;
- Brand registration;
- Legal trademark availability;
- Approval by a sports organization, platform, printer, or sponsor.
The client remains responsible for the commercial strategy, publication, printing, and use of the final design.
15. Refusal of a project
Saiyans may refuse or terminate a project involving:
- Illegal or infringing content;
- Hate speech or discriminatory content;
- Fraudulent or misleading information;
- Unauthorized identity or image use;
- Harassment, threats, or abusive communication;
- Non-payment;
- Repeated changes outside the agreed scope;
- Requests that could harm Saiyans’ reputation or professional integrity.
Where a project is terminated, any refund will be calculated according to the work already completed and costs already incurred.
16. File storage
Saiyans may retain project files for a limited period after delivery but does not guarantee permanent storage.
Clients are responsible for downloading, backing up, and securely storing their final files.
